We moved into a 3 bdrm in February of last yr, under the condition as soon as a bigger place became available we were next in line for it..A 4 bedroom is coming open this week so we went to talk to him about it..He said he was not going to allow us to move into the 4 bedroom because we have to much clutter? What? There are 6 of us in a 3 bdrm..My oldest has a room to herself, my two middle kids share a room and the baby is still in our room. Of course we have clutter!! We have 3 toddlers and a tween not to mention 2 adults..He said he didnt want to move us in to it until we could prove to him we can downsize and keep it that way..WHAT? My house is not dirty by any means and he even said he didnt have a problem with how I kept house however he didnt agree with the amount of stuff we have..6 ppl in a 989 sq ft home of course there isnt going to be room for everything. Thats why we need the space!!

by Anonymous - Original PosterJanuary 17 at 8:32 PMWe are looking into it but our lease ends next month on the 18th..and we are suppose to give a 30 day notice..he dont do month to month..So its either lose our deposit and have a mark against our credit or re-sign the lease..we really like where we are its close to the schools, we have a huge backyard, its just that hes being an ass..We have been on the waiting list a yr for a bigger home that he has promised us when it came available..

Unfortunately he has the right to say and do that....it's his house. Couldn't you move into an extended-stay hotel while you're looking for another place to live?

Put your complaint to him in writing and send it certified mail with green card receipt. State that you rented the 3 BR unit because there was no 4 bR available at the time and were promised that you could move to the other apartment with 4 BR as soon as one was available. Tell him that one is available and now he is refusing to let you move because you have furniture and materials for a larger family and therefore you need the 4 bedroom unit. Tell him you consider this a violation of your lease agreement since they promised you would get the next 4 bedroom and give him a short time to fix this situation.
Does he have to move your things or do you move your own things. I have never seen anything where a landlord has to move you so if you have to move your own things, why should it matter to him. If you are on subsidized housing, that might make a difference. 3 bedrooms should fit 6 people however, that may depend on the sex of the kids as you can argue boys together and girls together. If there is someone coming in with 8 people then they might qualify for the 4 bedroom under subsidized housing rules. If you wanted to get someplace else, this may be a violation of the lease and a possible break where you could move to a larger unit elsewhere. You might want to check with an attorney if he puts someone else in that unit. Good luck to you.

Check the state law on landlord tenant. Most places if the tenant pays the rent on time but does not sign up for a year, it could be for a month from whatever date you tell him you are leaving. You might be able to take another month and he'd have to prove that you damaged something in order to hold the deposit. You might have to sue, but there are triple damages if you win. Check with an attorney on this one. Might not be enough for it to be worthwhile. But do send the certified letter ASAP. He may say that your place is messy so you might need to take photos. the families he has in the 4 bdrms are two parents and 2-3 kids..we are 1 of 2 families promised a larger home when available..the other family has 3 kids, but 7 all together when her husbands other children visit on wknds.
they have been in there a while..well i talked to him today and asked him if yt was my housekeeping he said No its just that we had an abundance of furniture, toys, clothing and we have stuff stacked in every inch. Right now my house is a mess, I have been spring cleaning and have a closet full of goodwill donations that i am going to load up this weekend. Its just irritating. We have never had a problem with him and he has never had to contact us regarding anything except when the dogs next door got into our garbage and knocked them over n ripped open the bags..That neighbor has to keep his dog on a leash now at all times. Thats it.
I am looking for a place, but I am afraid we wont be able to before we have to sign the lease.

If you give your notice by tomorrow, you'll have your 30 day notice. So tell him you're giving your notice unless he gives you the larger place. I'm sure he doesn't want to go through the trouble of finding another renter.
